Terms of use
These Terms govern the online store photobaby.bg (Foto Baby EOOD, Plovdiv). By placing an order you fully accept them. Products are made to order from your photos. Personalised items may be returned only if defective or not as described — contact us within 14 days of delivery.
I. General provisions
1. These Terms set out how the merchant provides services via photobaby.bg. They bind all users. Placing an order means you accept and will comply with them. 2. Identification of the customer (acceptance of the Terms and the order) relies on server logs (including IP address) and the details you provide at checkout. 3. Products on the site are a demonstrative online catalogue and are not a unilaterally binding offer until the order is confirmed. 4. Clicking the order button is a legally binding offer to buy the items in your cart. You receive email confirmation; the contract is concluded upon that confirmation. 5. We may refuse delivery of a confirmed order if goods cannot be supplied or produced. We will notify you within the working week by email or phone. If a bank transfer was already received, you may choose a refund, cancellation, or a replacement order. 6. The contract language is Bulgarian. Prices and payments are in euros (EUR) including VAT.
II. Delivery
7. Delivery is via Speedy and Econt — to an office, locker, or address — or free store pickup in Plovdiv (Trakia 148, ent. A). Approximate courier shipping is shown at checkout and is included in the order total. 8. Risk of damage or loss in transit passes to you after we hand the parcel to the courier. We are not liable for delays caused by the courier. 9. Inspect goods immediately on receipt. Report transport damage at once. If goods clearly do not match the order, you may request a replacement within 24 hours of receipt. 10. An unjustified refusal to accept delivery means you owe outbound and return shipping. We are not obliged to fulfil orders with wrong address or phone details.
III. Prices and payment
11. Site prices are in euros (EUR) including VAT. Courier shipping is calculated at checkout (live quote or estimate) and included in the order total, except free store pickup. 12. We accept cash on delivery (pay the courier the full amount on receipt) and bank transfer. For bank transfer, production/shipping starts after payment clears. Use your order number as the payment reference.
IV. Customer rights and duties
13. You may browse and order listed goods and ask about your order status. 14. You are responsible for keeping your username and password safe and for actions taken through your account. Notify us immediately of suspected unauthorised access. 15. You must provide accurate contact and delivery details, pay the price and shipping (when not free), enable delivery/pickup, and upload only photos you have rights to use. We may refuse illegal or inappropriate content. 16. When using the site you must obey Bulgarian law, respect others’ rights, and not distribute malware or harmful content.
V. Merchant rights and duties
17. After due payment (or after a confirmed COD order) we transfer ownership of the made-to-order goods and deliver or prepare them for pickup within a reasonable time. 18. We may suspend or change services if these Terms are breached or for objective necessity, and we are not liable for events beyond our control (including internet or courier issues). 19. We may collect and use data to improve services in line with law and our Privacy Policy. Objections can be emailed to photo_baby@abv.bg.
VI. Personal data and cookies
20. Confidentiality of personal data is guaranteed under GDPR and Bulgarian law. Details are in the Privacy Policy. Data is not shared with third parties except as required by law or with explicit consent. 21. The site may use cookies for store operation and — only with consent — analytics cookies (e.g. Google Analytics). Preferences are available in the footer (“Cookie settings”).
VII. Amendments
22. We may amend these Terms and service features, including for legal changes. Changes are published prominently with a reasonable review period. If you do not reject them within that period, you are bound by the new Terms.
VIII. Definitions and disputes
23. “User/customer” means anyone using photobaby.bg. “Order” means the selected goods and delivery/payment attributes. The photobaby.bg store is owned by Foto Baby EOOD. 24. Disputes are resolved amicably where possible. Otherwise by the competent court at the merchant’s registered seat under Bulgarian law (Plovdiv).
